GENERAL TERMS AND CONDITIONS

I. INTRODUCTION

Welcome to the KOZELINO online store, located at www.kozelino.bg. These General Terms and Conditions govern the relationship between Eco Plast BG Ltd. and visitors to the website, as well as users of the online store. By using this website and making purchases through the online store, you agree to comply with these General Terms and Conditions.

Eco Plast BG Ltd., with UIC: 207674053, is registered with its headquarters and management address in Varna, Bulgaria, at Primorski District, Chaika Residential Complex, Block 5, Entrance E, Floor 1, Apartment 16, Postal Code 9000.

II. GENERAL PROVISIONS

1. These General Terms and Conditions, under which the MERCHANT provides services to USERS through the online store www.kozelino.bg, are binding for all USERS. By accessing the website www.kozelino.bg, the USER agrees to, fully accepts, and undertakes to comply with these Terms and Conditions.

2. USERS are identified to ensure the reproduction of their declarations of acceptance of the General Terms and Conditions and for placed orders. Identification is carried out through the log files stored on the server www.kozelino.bg, the storage of USERS’ IP addresses, and any other information submitted by them.

3. By clicking the “Order” button, USERS agree to purchase the items in their shopping cart.

4. This action has legal binding force. USERS receive an order confirmation, and with this, the contract is considered concluded.

5. The contract language is English, and all payments are made in Bulgarian Lev (BGN), including VAT.

III.  DELIVERY AND RETURNS

1. Delivery of goods purchased from www.kozelino.bg is carried out exclusively by courier. The available delivery options depend on the services provided by the courier for the respective location.

2. The MERCHANT is not responsible for delays if the delay is caused by the courier company.

3. If a courier service with the “Review” option is selected and discrepancies with the ordered goods are found, the USER has the right to return the goods at the time of delivery at his expenses.

3.1. The MERCHANT is not responsible for any damage that occurs during transportation.

3.2. The USER must immediately notify the courier about any damages detected upon delivery.

3.3. If the USER accepts the delivery without objections under the “Review” option, all subsequent claims for visible defects in the received goods will be considered invalid and will not be accepted.

4. When a specific delivery date and time have been set in writing by the MERCHANT, this statement has a binding force. If an incorrect or incomplete address, contact person, or phone number is provided, the MERCHANT is not obligated to fulfill the order.

4.1. Upon receipt of the goods, the USER or a third party signs the accompanying documents. A third party is considered anyone who is not the applicant but receives the goods at the delivery address specified by the USER.

4.2. If the USER refuses to accept the goods for reasons not covered in the return policy, the refusal will be considered unjustified, and the USER will be required to cover the costs of delivery and return

4.3.  If the USER is not available at the specified address during the delivery timeframe, fails to provide access for delivery, or has a history of refused deliveries, the MERCHANT is released from its obligation to deliver the ordered goods.

5. The USER has the right to cancel the contract without compensation, penalties, or stating a reason within 14 calendar days from the date of receiving the goods.та.

This right does not apply in the following cases:

– Delivery of goods custom-made or specifically tailored to the USER’s requirements (e.g., liquid wallpapers in non-standard colors).

– Products damaged due to improper use by the USER.

– Products with damaged original packaging.

5.1. The USER must request a return by contacting the MERCHANT at contact@kozelino.bg within the specified 14-day period.

5.2. The USER is responsible for covering the return shipping costs, except when the goods are defective, damaged, or incorrectly supplied due to the MERCHANT’s fault.

5.3. The USER must send the goods back to the MERCHANT within 7 days from the date of notifying the MERCHANT about the cancellation decision. Returned products must be in their original packaging and include all accessories, consumables, and manuals.   

5.4. The MERCHANT is not obliged to refund additional shipping costs if the USER has chosen a delivery method other than the cheapest standard shipping offered by the MERCHANT.

5.5. The MERCHANT may withhold the refund until the returned goods are received.

5.6. Refunds will be issued via the same payment method used by the USER, unless the USER has explicitly agreed to a different method, provided it incurs no additional costs for them.

6. Delivery costs are separate from the price of the goods.

7. If the MERCHANT is unable to fulfill the order due to stock unavailability, the USER will be notified within 72 hours via the provided phone number or email. If this period falls on a non-business day, notification will be made by the end of the third business day. If the goods were prepaid, the MERCHANT will issue a full refund to the USER.

8. The MERCHANT may request additional confirmation of the order. If the USER refuses to provide the requested information, the order will be automatically canceled.

IV. PRICES

1. The prices on this website may differ from those announced elsewhere.

2. Prices are in Bulgarian Lev (BGN) and are valid only in Bulgaria, Greece, and Romania.

3. Prices include VAT but do not include delivery costs.

4. If a pricing error is discovered, it will be corrected in the system, and the updated price will apply to the USER’s order. The MERCHANT reserves the right to cancel any order and correct errors, inaccuracies, or omissions, even after an order has been placed.

5. Goods can be shipped to Romania and Greece only upon a specific request from the USER to the courier service.

6. Before concluding the contract, the MERCHANT will inform the USER of the total order value, including delivery costs.                   

7. The USER agrees that the MERCHANT has the right to request advance payment for orders.

8. The USER can choose to pay before or at the time of delivery.

9. Card payments can be made on www.kozelino.bg via Visa, MasterCard, or Maestro through the virtual POS terminal of DSK Bank AD, part of OTP Group.

10. Payment security is ensured through the MasterCard Identity Check and VISA Secure programs.

V. PAYMENT METHODS

We accept payments via Cash on Delivery, Bank Card, and Bank Transfer.

1. Cash on Delivery Payment:

1.1. When paying via Cash on Delivery, the CUSTOMER pays for the shipment upon delivery.

1.2. When paying via Cash on Delivery, the CUSTOMER makes the payment directly to the delivery company and receives a corresponding payment document from them.

1.3. The CUSTOMER may pay in cash or by Bank Card if the delivery company offers such a payment method.

2. Payment by Card via Virtual POS:

2.1. When paying by Card via the Virtual POS of the servicing banking institution, you will be required to enter your card number, expiration date, and CVV/CVC. If your card is part of the MasterCard Identity Check or VISA Secure security programs, you will also need to enter a 3-D Secure password.

2.2. We, at www.kozelino.bg, operated by Eco Plast BG, do not collect, process, or store card data. All card details are entered personally by you on the secured payment page of our servicing bank.

2.3. Regardless of the currency of your bank account, the transaction will be processed in Bulgarian leva (BGN) according to the bank’s current exchange rate. All prices are final and include VAT.

2.4. In cases where a refund is required, whether in full or in part, and the payment was made by Card, we will process the refund as a reversal transaction to the original Card used for payment within 7 business days.

2.5. For security reasons, the maximum amount allowed for payment by Bank Card is BGN 9750.


3. Payment by Bank Transfer

A bank transfer payment redirects you directly to your bank’s online banking system, where the payment details are automatically populated.

VI. RIGHTS AND OBLIGATIONS OF THE USER

1. The USER has the opportunity to browse and, after registration or as a guest, order the listed products from the online store – www.kozelino.bg.

2. The USER has the right to be informed about the status of their order.

3. The USER is fully responsible for safeguarding their username and password, as well as for all actions performed by them or a third party using their username and password. The USER is obliged to immediately notify the MERCHANT of any unauthorized access using their username and password, as well as whenever there is a risk of such use. 

3.1. If the USER provides false, inaccurate, outdated, or incomplete information, the MERCHANT has the right to close and/or delete information related to their mailing address/user profile and deny them further access to part or all of its services.

3.2. Minors may use the services of www.kozelino.bg only with the permission of a parent or guardian. The MERCHANT reserves the right to refuse services, deactivate accounts, add or remove content, or cancel orders at its discretion.

4. The USER is obliged to pay the price of their order in accordance with these General Terms and Conditions.

5. Every USER, regardless of whether they are a client of the MERCHANT, is required, when using the services:

5.1. Not to violate and to respect the fundamental rights and freedoms of citizens and human rights, in accordance with the Constitution and laws of the Republic of Bulgaria and recognized international acts.

5.2. Not to harm the good name of others and not to incite violent changes to the constitutionally established order, the commission of crimes, violence against individuals, or the incitement of racial, national, ethnic, or religious hatred.

5.3. Not to infringe upon the property or non-property, absolute or relative rights and interests of others, such as ownership rights, intellectual property rights, etc.

5.4. To comply with Bulgarian legislation, applicable foreign laws, moral rules, good manners, and Internet etiquette when using the services provided by www.kozelino.bg.

5.5. To immediately notify the MERCHANT of any violation discovered while using the provided services.

5.6. Not to upload, send, transmit, distribute, or use in any way software, computer programs, files, applications, or other materials containing computer viruses, unauthorized remote control systems, computer codes, or materials intended to disrupt, hinder, damage, or restrict the normal functioning of computer hardware or software, telecommunications equipment, or to enable unauthorized access to foreign resources or software.

5.7. Not to engage in malicious activities.

5.8. o compensate the MERCHANT and all third parties for any damages and lost profits, including any costs and legal fees, incurred as a result of claims and/or paid compensations to third parties due to Internet pages, materials, or information that the USER has used, placed on the server, sent, distributed, made available to third parties, or made accessible through www.kozelino.bg in violation of the law, these General Terms and Conditions, good morals, or Internet etiquette.

6. The USER is obliged to provide an accurate and valid phone number, delivery address, and email address, to pay the price of the product, to cover the delivery costs when not free, and to ensure access and the ability to receive the product. Unless explicitly stated otherwise, the delivery is considered paid.

VII. RIGHTS AND OBLIGATIONS OF THE MERCHANT

1. The MERCHANT has no obligation and no objective ability to control how USERS utilize the provided services.

2. The MERCHANT has the right, but not the obligation, to store materials and information located on the server of www.kozelino.bg.

3. The MERCHANT has the right at any time, without notifying the USER, to terminate, suspend, or modify the provided services related to the use of the site if the USER violates these terms or at the discretion of the MERCHANT. The MERCHANT is not liable to USERS or third parties for damages or lost profits resulting from the termination, suspension, modification, or limitation of services, deletion, modification, loss, inaccuracy, or incompleteness of messages, materials, or information transmitted, used, stored, or made available through www.kozelino.bg.

4. Upon receiving payment, the MERCHANT is obliged to transfer ownership and hand over the purchased product to the courier company within the agreed timeframe.

5. The MERCHANT has the right to collect and use information related to its USERS, regardless of whether they are registered.

6. The MERCHANT is not responsible for failure to fulfill its obligations under this contract in the event of unforeseen circumstances that it could not have predicted or was not obliged to foresee, such as random events, problems in the global Internet network, and service disruptions beyond the MERCHANT’s control.

7. The MERCHANT has the right to install cookies on users’ computers. These are text files stored by the website on the USER’s hard drive, allowing the retrieval of USER information, identifying them, and tracking their actions, the websites they visit, the hyperlinks they use, and the information they access and record.

8. The MERCHANT is not responsible for discrepancies in product color variations due to individual display settings and different screen resolutions.

9. The MERCHANT reserves the right to maintain different pricing for products on www.kozelino.bg compared to other physical or online stores. The prices are valid only for products and services listed on the www.kozelino.bg website.

VIII. PRIVACY POLICY AND PERSONAL DATA

1.The MERCHANT guarantees the confidentiality of the information and personal data provided by its USERS. This information will not be used, provided, or disclosed to third parties except under the conditions specified in these General Terms and Conditions.

2. The MERCHANT protects the USER’s personal data obtained when filling out the electronic purchase request form, except in cases where the USER has provided false information. In compliance with applicable law and these General Terms and Conditions, the MERCHANT may use the USER’s personal data only for purposes related to the contract. Any other use will comply with Bulgarian law, international regulations, Internet etiquette, moral standards, and good practices.

3. The MERCHANT undertakes not to disclose any USER personal data to third parties, including government agencies, companies, individuals, etc., except in cases where:

  • The USER has given explicit written consent.
  • The information is required by government authorities authorized by law to request such information, and the MERCHANT is legally obligated to provide it.

IX. INTELLECTUAL PROPERTY

1. Trademarks, service marks, and logos (“Trademarks”) used and displayed on this site are registered and unregistered trademarks of Eco Plast BG Ltd. The KOZELINO name, KOZELINO logo, or other registered trademarks of KOZELINO may not be used in any way, including in advertising or promotional materials related to the distribution of content from this site, without prior written permission from Eco Plast BG Ltd.ОД.

2. The MERCHANT prohibits the use of the KOZELINO emblem as part of a link to or from any site unless such a link is expressly approved in writing by Eco Plast BG Ltd.

X. AMENDMENTS

1. The General Terms and Conditions may be changed at any time by the MERCHANT, who also has the right to modify the characteristics of the provided services and these General Terms and Conditions at its discretion.
2. The MERCHANT is obligated to notify the USER of any changes to the General Terms and Conditions by publishing a notice of the amendments in a visible place on its website.

XI. THIRD PARTIES

This website may contain links to sites owned or operated by companies other than Eco Plast BG Ltd. These links are provided for reference only. Eco Plast BG Ltd. does not control external sites and is not responsible for their content.

XII. OTHER CONDITIONS

1. For matters not settled in this agreement, related to its execution and interpretation, the laws of the Republic of Bulgaria shall apply.

2. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. If an agreement is not reached, all unresolved disputes, including disputes arising from or related to the interpretation, invalidity, execution, or termination of the agreement, as well as disputes concerning the filling of gaps in the agreement or its adaptation to newly arisen circumstances, shall be resolved by the competent court at the place of registration of the MERCHANT, in accordance with Bulgarian legislation.

3. These terms and conditions apply to all users of www.kozelino.bg.

The personal data received by www.kozelino.bg during the USER registration process on the website will be used solely for serving the USERS—accepting and processing orders and contacting USERS in case of issues related to an order.

www.kozelino.bg guarantees that such data will not be provided to third parties in any form or used for purposes other than those described.

In accordance with the Personal Data Protection Act, the USER has the right to access their personal data entered or made available to Eco Plast BG Ltd. while using the site, as well as to correct such personal data.

By accepting these terms and conditions, USERS who have registered a username and password explicitly agree that the personal data they provide (including their chosen username and password) may be processed electronically by www.kozelino.bg for the delivery of ordered goods or services and for assistance when needed from a www.kozelino.bg employee.

All personal data and other information voluntarily provided by the USER during their use of the website are stored, processed, and used by www.kozelino.bg to maintain certain functionalities of the services offered.

www.kozelino.bg explicitly informs USERS that the provided personal data will not be disclosed to third parties for advertising and promotional purposes.

www.kozelino.bg reserves the right to use IP addresses and other user data to identify USERS when necessary to comply with the law, legal procedures, or to enforce these terms and conditions.
